Elective share

A statutory right of a surviving spouse to claim a specified portion of their deceased spouse's estate, regardless of the provisions in the will. This right is designed to prevent a spouse from being disinherited entirely. The size of the elective share varies by jurisdiction, often ranging from one-third to one-half of the augmented estate.
