Augmented estate

A concept used in some states' probate laws to determine a surviving spouse's elective share, encompassing not only the decedent's probate estate but also certain non-probate transfers. This includes assets transferred by the decedent during life with retained control or transferred shortly before death. It prevents a spouse from being disinherited through inter vivos transfers.
