Statutory share

The portion of a deceased person's estate that a surviving spouse can claim under a statute regardless of what the will provides, also called the elective share. It protects the spouse from disinheritance and is typically a fixed fraction of the estate, such as one third or one half depending on the state. Jurisdictions with forced heirship rules, such as Louisiana, reserve a share for certain children as well.
