Spousal share

The portion of a deceased spouse's estate that the surviving spouse is legally entitled to receive. This entitlement exists even if the will specifies a smaller amount or disinherits the survivor entirely. The exact percentage or amount of the elective share varies significantly by state law, often ranging from one-third to one-half of the estate.
