Equitable ownership

The beneficial interest in property, recognized by courts of equity, where one party holds legal title but another party enjoys the benefits of ownership. This form of ownership often arises in trusts, where a trustee holds legal title for the benefit of a beneficiary. The equitable owner has the right to use, possess, and enjoy the property, even if they do not hold the deed.
