Estoppel by silence
Term · Law · MLC-T-LAW-001929
A legal doctrine that prevents a person from asserting a right or claim when they remained silent or failed to act when they had a duty to speak or act, and another party relied on that silence to their detriment. This form of estoppel arises when a person's inaction leads another to reasonably believe a certain state of affairs exists. It requires knowledge of the facts and an opportunity to speak.
