Evaluative fact

A statement that, while appearing to be an opinion, implies the existence of underlying facts that support the evaluation. This type of statement can be actionable in defamation law if the implied facts are false and damaging. For example, stating that a product is "defective" is an evaluative fact that implies underlying factual flaws.
