Any form of proof presented at a trial or hearing to persuade the judge or jury of the truth or falsity of a factual assertion. Evidence includes testimony from witnesses, physical objects like documents or weapons, and demonstrative items such as charts or diagrams. The admissibility of evidence is governed by strict procedural rules, such as the Federal Rules of Evidence, which address relevance, hearsay, and privilege.
Any material, object, or information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case in favor of one side or the other. The federal courts must follow the Federal Rules of Evidence.
