Federal question jurisdiction

  1. The authority of federal courts to hear cases arising under the United States Constitution, federal laws, or treaties. This type of jurisdiction allows a case to be brought in federal court even if the parties are from the same state. The claim must directly involve a federal law as a necessary element of the plaintiff's cause of action.

  2. Jurisdiction given to federal courts in cases involving the interpretation and application of the U.S. Constitution, acts of Congress, and treaties.
