Fertile-octogenarian rule

A common law presumption that an individual, regardless of age or physical condition, is capable of having children. This rule historically impacted property law, particularly in determining the validity of future interests in trusts and estates. It often led to the invalidation of certain property dispositions under the Rule Against Perpetuities, which prevents property from being tied up indefinitely.
