Flight

Term · Law · MLC-T-LAW-002152

The act of a person accused or convicted of a crime of absconding or fleeing from law enforcement to avoid arrest, prosecution, or imprisonment. Evidence of a defendant's flight is often admissible in court as circumstantial evidence of consciousness of guilt. A jury instruction on flight informs jurors that they can infer guilt from the defendant's act of fleeing, though it is not sufficient on its own to establish guilt.
