Term · Law · MLC-T-LAW-005309

To divide a trial into two separate stages, with each stage addressing a different issue. In criminal law, a trial is often bifurcated into a guilt phase, where the jury determines if the defendant committed the crime, and a penalty phase, where the appropriate sentence is decided. This procedure is standard in capital cases where the jury must first determine guilt before considering the death penalty.
