Relating to the specific case, motion, or matter currently under consideration by a court or being discussed in a legal document. The term is used in judicial opinions and legal briefs to distinguish the present matter from other cases cited as precedent or for comparison. For example, a judge might write, "The facts of the precedent are distinguishable from those of the instant case," to justify a different outcome.
