Instance and expense test

A test under the 1909 Copyright Act for deciding whether a commissioned work counts as a work made for hire, so that the hiring party is treated as its author. A work qualifies if it was created at the hiring party's instance, meaning the party motivated its creation and had the right to direct or supervise it, and at that party's expense. Courts apply it to works created before the 1976 Act took effect.
