Marketable title

A title to real property that is free from reasonable doubt as to its validity and would be accepted by a reasonably prudent buyer acting in good faith. This means the title is free from undisclosed encumbrances, defects, or claims that would expose the buyer to litigation or impair their quiet enjoyment of the property. A title search and examination are typically conducted to confirm marketable title before a real estate transaction closes.
