Mistake of fact

An erroneous belief about a factual matter that, in some legal contexts, can negate the mental state required for a crime or invalidate a contract. For a mistake of fact to be a defense in criminal law, it must generally be both honest and reasonable. In contract law, a mutual mistake of material fact can make an agreement voidable.
