Patent ambiguity

Term · Law · MLC-T-LAW-003650

An uncertainty or lack of clarity in a legal document that is evident on the face of the document itself, without the need for external evidence or interpretation. This type of ambiguity arises from the words used and their arrangement. Courts generally do not admit extrinsic evidence to resolve a patent ambiguity, as it is considered a defect in the drafting.
