Patent defect

A flaw or imperfection in goods or property that is readily discoverable upon reasonable inspection. This type of defect is apparent to an ordinary observer and does not require specialized knowledge or testing to uncover. In real estate transactions, patent defects are usually not grounds for rescission if the buyer had an opportunity to inspect.
