Prenatal tort

A civil wrong that causes injury to a fetus before birth. If the child is born alive, a lawsuit can be brought on the child's behalf for injuries sustained in the womb, such as those caused by medical malpractice or a car accident. Some jurisdictions also permit wrongful death actions if the injury results in a stillbirth after the fetus has reached viability.
