Prior restraint

Governmental action that prohibits speech or expression before it takes place. This is a severe form of censorship and is generally presumed to be unconstitutional under the First Amendment. Courts impose a heavy burden on the government to justify any prior restraint, requiring proof that the speech would cause direct, immediate, and irreparable harm.
