Restraint on alienation

A provision in a deed, will, or contract that restricts the owner's ability to sell, transfer, or otherwise dispose of property. These limitations are disfavored by law because they hinder the free transferability of property. Courts will invalidate such restraints if they are absolute or unreasonable in their scope or duration.
