Alienation

The voluntary act of transferring property, or a right in property, from one person to another, such as by sale or gift. This legal concept encompasses the complete and voluntary surrender of ownership and possession. A restraint on alienation is a clause in a deed or will that attempts to prohibit the recipient from selling or transferring their interest in the property.
