Deadhand control

The influence that a deceased owner keeps over property through conditions in a will, trust or deed, such as limits on heirs or on uses of the land. The common law restrains it with the rule against perpetuities and the rule against unreasonable restraints on alienation. The related term mortmain referred to land held permanently by religious or corporate bodies, which could never be sold or inherited.
