Race statute

A type of recording act that determines priority of interests in real property based solely on which instrument was recorded first. Under a pure race statute, the first party to record their deed or other interest takes priority, regardless of whether they had notice of prior unrecorded interests. These statutes encourage prompt recording of property interests.
