Quotient verdict
Term · Law · MLC-T-LAW-004099
An improper method for a jury to determine a damage award, where jurors agree in advance to be bound by the average of the amounts each juror individually proposes. The individual figures are summed and then divided by the number of jurors to arrive at the final award. Because this method involves a prior agreement to abdicate individual judgment in favor of a mathematical formula, such verdicts are invalid and can be grounds for a new trial.
