Separate property

Assets owned by one spouse before a marriage, or acquired during the marriage by individual gift or inheritance. In the context of divorce, separate property is not subject to the same rules of division as marital or community property, which is acquired through joint efforts during the marriage. The character of an asset can change from separate to marital if it is commingled with marital assets to the point where its origin can no longer be traced.
