Shifting executory interest

A future interest in property that divests a prior estate in a grantee and transfers it to another grantee upon the occurrence of a specified condition. Unlike a springing executory interest, which divests the grantor, a shifting interest takes effect by cutting short an estate held by someone other than the grantor. This type of interest is a form of executory limitation, which became possible after the Statute of Uses in 1536.
