Tender back rule

A principle requiring a party who wants to rescind a contract or settlement agreement to first return any money or other consideration they received under that agreement. By returning the benefits, the party restores the other side to the position they were in before the contract was made, which is a precondition for challenging its validity. Some jurisdictions have modified or abolished this rule in specific contexts, such as employment discrimination cases.
