Back pay

Wages and benefits an employee should have received but did not, either because the employer failed to pay what was earned or because an unlawful firing, demotion or discrimination cut off income. A court or agency orders it as a remedy under laws such as Title VII and the National Labor Relations Act, and it generally runs from the violation until judgment or reinstatement, reduced by interim earnings. Under Title VII, back pay liability stops accruing two years before the filing of the charge.
