Undue influence

The improper use of power or trust in a way that deprives a person of their free will and substitutes another's objective. This occurs when one party, through a position of dominance, persuades another to act against their own best interests. Courts examine factors such as the vulnerability of the victim and the nature of the relationship between the parties.
