Undue hardship

An action requiring major difficulty or expense for an employer in providing a reasonable accommodation, which excuses the employer from the duty to accommodate under the Americans with Disabilities Act. It is judged case by case using factors such as the nature and cost of the accommodation, the financial resources of the facility and the employer, and the effect on operations. Title VII's religious accommodation rule uses its own test, a burden that is substantial in the context of the employer's business, set by the Supreme Court's 2023 Groff decision.
