Vacatur

The act of a court setting aside or annulling a prior judgment, order, or proceeding, effectively making it void. A party can file a motion for vacatur based on specific grounds, such as a fundamental procedural error, fraud committed on the court, newly discovered evidence, or a lack of jurisdiction. Unlike an appeal, which reviews a decision for legal error, a successful vacatur nullifies the original ruling and restores the case to the status it had before the judgment was entered.
