Severance

The legal separation of a mineral estate from the surface estate, allowing different parties to own and control the rights to the minerals and the land above them. This division can occur through a deed, reservation, or other legal instrument. Once severed, the mineral estate can be leased, sold, or otherwise transferred independently of the surface.
