Constructive discharge
Term · Insurance and risk management · MLC-T-INS-000920
A doctrine of employment law under which an employee who resigns because working conditions have become so intolerable that a reasonable person would feel compelled to quit is treated as having been fired. It lets the employee pursue wrongful termination or discrimination claims as if the employer had dismissed him or her. Courts judge the conditions objectively, and a single unpleasant incident is usually not enough.
