Direct threat

A high probability of substantial harm to the health or safety of an individual or others in the workplace. This assessment considers the duration of the risk, the nature and severity of the potential harm, the likelihood that potential harm will occur, and the imminence of the potential harm. Employers must demonstrate that an individual poses a direct threat to justify denying employment or imposing restrictions under the Americans with Disabilities Act.
