Kotecki waiver

A contractual agreement in which an employer waives the liability cap on third-party contribution claims provided by the Illinois Supreme Court's decision in Kotecki v. Cyclops Welding Corp. By signing the waiver, an employer agrees to assume unlimited liability for contribution in a lawsuit brought by its injured employee against a third party. This waiver is a condition for the employer to receive indemnification from the third party under a separate contractual provision.
