Manifestation theory

Term · Insurance and risk management · MLC-T-INS-002117

A legal doctrine used in insurance to determine which policy applies to a loss that develops over time, such as environmental contamination or latent defects. Under this theory, coverage is triggered by the policy in effect when the damage or injury first becomes apparent or discoverable, regardless of when the causative event occurred. This approach contrasts with exposure or injury-in-fact theories.
