The practice in some states, particularly Texas, where employers opt out of the state's workers' compensation system. Instead, these employers provide alternative occupational injury benefit plans for their employees. Nonsubscribing employers lose certain legal protections, such as immunity from common law negligence suits, which are typically afforded to workers' compensation subscribers.
