Public policy exception

Term · Insurance and risk management · MLC-T-INS-002758

A legal principle that allows courts to invalidate or refuse to enforce certain contractual provisions, including those in insurance policies, if they are deemed to violate fundamental societal values or laws. This exception prevents agreements that would otherwise be legal from being upheld if they contradict the public good or established moral principles. For example, an insurance policy covering intentional criminal acts would typically be voided under this doctrine.
