Ancillary probate

A secondary probate proceeding initiated in a state where a deceased person owned real estate, but which was not their primary residence. This process is required to legally transfer title of the out-of-state property to the heirs or beneficiaries. It runs concurrently with, and is subordinate to, the main probate administration in the decedent's domiciliary state.
