Capricious

Describing an action or decision, particularly by a court or administrative agency, that is impulsive, unpredictable, and made without a rational basis or consideration of the facts and law. Such a determination is considered an abuse of discretion because it lacks a discernible, logical foundation. Under the Administrative Procedure Act, federal courts must set aside agency actions found to be arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.
