Collateral order doctrine

Term · Law · MLC-T-LAW-005316

A legal principle allowing immediate appellate review of certain trial court orders that do not dispose of the entire case. For an order to be appealable under this doctrine, it must conclusively determine a disputed question, resolve an issue separate from the merits of the action, and be effectively unreviewable on appeal from a final judgment. This doctrine is a narrow exception to the final judgment rule in federal courts.
