Eggshell skull rule

Term · Law · MLC-T-LAW-001816

A doctrine in tort law that holds a defendant responsible for all damages resulting from their tortious conduct, even if the plaintiff's pre-existing physical or psychological condition made the injuries more severe than they would have been for an average person. This rule prevents a defendant from claiming that the plaintiff's unusual susceptibility should reduce the defendant's liability. It is also known as the "thin skull rule" and is widely applied in personal injury cases.
