Eggshell skull

Term · Law · MLC-T-LAW-001815

A legal principle in tort law stating that a defendant takes their victim as they find them, meaning the defendant is liable for the full extent of the plaintiff's injuries, even if the plaintiff had a pre-existing condition that made them more susceptible to severe harm. This rule prevents a defendant from arguing that the plaintiff's unusual fragility should mitigate the defendant's liability. It applies regardless of whether the defendant was aware of the plaintiff's particular vulnerability.
