Excusable neglect

A failure to act within a required time that results from a mistake, inadvertence, or oversight a court finds forgivable, so that a missed deadline may be extended or a default set aside. Courts weigh the reason for the delay, its length and effect on the proceedings, the prejudice to the other side, and the movant's good faith, following Pioneer Investment Services v. Brunswick Associates (1993).
