Express trust

A fiduciary arrangement created intentionally by a settlor, typically in writing, to transfer property to a trustee for the benefit of designated beneficiaries. The terms and conditions of the trust are clearly stated and defined. This type of trust is formed through a deliberate act, as opposed to a constructive or resulting trust which arises by operation of law.
