Constructive trust

A legal remedy created by a court to compel a person who has wrongfully acquired property to transfer it to the intended beneficiary. It is imposed to prevent unjust enrichment when a party obtains property through means such as fraud, mistake, or breach of a fiduciary duty. Unlike an express trust, a constructive trust is not established by a settlor's intent but is instead an equitable fiction imposed by judicial action to achieve justice.
