A legal fiction where a situation or fact is treated as existing, even if it does not literally or actually exist, for the purpose of achieving a just or equitable outcome. This concept allows courts to infer certain conditions or relationships based on the actions or inactions of parties. It is often used to prevent unjust enrichment or to enforce obligations.
