Legal fiction

An assumption of fact made by a court for the purpose of achieving justice or convenience, even if the assumption is known to be untrue. This device allows courts to apply existing legal rules to new situations or to overcome technical difficulties. An example is the concept of a corporation being treated as a 'person' in law.
