Impute

Term · Law · MLC-T-LAW-002530

To attribute an action, fault, or quality to a person based on their relationship with another, even without direct involvement. This legal fiction holds one party vicariously liable for the conduct of another, such as when an employer is held responsible for an employee's negligence under the doctrine of respondeat superior. Courts also impute income to an underemployed parent for child support calculations based on earning capacity rather than actual earnings.
